Executive Order Relating to Artificial Intelligence
On December 11, 2025, the President issued an Executive Order (the Order) relating to the development of a national policy framework for artificial intelligence (AI), a topic that has been at the forefront of both industry and regulators’ minds. Pursuant to the Order, the policy of the United States, as it related to AI, is to “sustain and enhance the United States’ global AI dominance through a minimally burdensome national policy framework”.
In order to accomplish this stated policy, the Order requires the formation of a task force (as defined within the Order) to identify and publish a list of laws that conflict with the aforementioned policy as well as laws that should be referred to the task force to be challenged “on grounds that such laws unconstitutionally regulate interstate commerce, are preempted by existing Federal regulations, or are otherwise unlawful in the Attorney General’s judgment[.]” The Order goes on to state that laws that “require AI models to alter their truthful outputs, or that may compel AI developers or deployers to disclose or report information in a manner that would violate the First Amendment or any other provision of the Constitution” must be identified. These tasks must be completed within 90 days of the issuance of the Order. FEMA Saw 50% Rise in Number of Participating Reinsurers for 2025 NFIP Renewal
The U.S. Federal Emergency Management Agency (FEMA) has now reported the participants on the National Flood Insurance Program’s (NFIP) reinsurance placement for 2025, with a 50% increase in the number of participants when compared with the previous year. Launch of the West Coast Health Alliance
On September 3, 2025, Governor Tina Kotek announced, with the Governors of California and Washington, the launch of the West Coast Health Alliance (WCHA). The state of Hawaii joined the Alliance on September 4, 2025. Through this Alliance, the states will coordinate health guidelines by aligning immunization recommendations informed by trusted national medical organizations. The Alliance issued the WCHA 2025-2026 Respiratory Virus Season Immunization Recommendations that include COVID-19 vaccine recommendations. NAMIC Voices Support for FEMA Reform Bill
The National Association of Mutual Insurance Companies (NAMIC) on Thursday called on U.S House leaders to pass a bipartisan bill containing sweeping reforms to the Federal Emergency Management Agency (FEMA). NCOIL Adopts Model Law to Overhaul Prior Authorization Practices
Rep. Michael Sarge Pollock of Kentucky, chair of the Health Insurance & Long Term Care Issues Committee, said the Model reflects extensive work by the committee over the past year and addresses one of the most widely debated issues in the health care sector. He credited Senator Michel for bringing his experience from Mississippi’s reform effort into the NCOIL process. NCOIL Discusses Prior Authorization Reform at Annual Meeting
The Life Insurance & Financial Planning Committee then met, Chaired by Rep. Carter. The Committee continued its discussion on the NCOIL Model Act Regarding Life Insurers’ Use of Genetic Information, sponsored by Rep. Carter, and heard different perspectives on the issue from Professor Anya Prince at the University of Iowa College of Law, and Dr. Deborah VanDommelen, Chair of the American Council of Life Insurers (ACLI) Risk Classification Committee. NICB Urges Consumers to Take Action Against Rising Insurance Fraud Losses
In partnership with the Anti-Fraud Alliance, NICB has launched a national campaign encouraging consumers to learn about insurance fraud, share prevention tips within their communities and report suspicious activity that contributes to higher insurance costs. Alaska Eliminates TPA Licensing Exemptions
The Alaska Division of Insurance issued a Bulletin with new guidance for Third Party Administrators (TPAs) operating in the state based on changes to the law made by Alaska Senate Bill 132, effective Jan. 1, 2026. Bulletin B 25-09, </a> published on Dec. 2, 2025. 
Senate Bill 132 amended AS 21.27.650(a)(2) to eliminate the exemption from the TPA licensing requirement that previously applied to a TPA that: (1) filed a certification with the Division certifying that the TPA is operating only for a foreign insurer other than a self-funded multiple employer welfare arrangement regulated under AS 21.85; and (2) is registered as a TPA by the TPA’s resident insurance regulator in a state that the Division has determined has enacted provisions substantially similar to those contained in AS 21.27.630 — 21.27.650 and that is accredited by the NAIC.  
Additionally, the exemption from the TPA licensing requirement that was previously available pursuant to AS 21.27.630(f) has also been repealed. AS 21.27.630(f) previously exempted a person who performs management services for an admitted insurer if the person's compensation is not based on the volume of premium written and the person (1) is a wholly-owned subsidiary of the admitted insurer; (2) wholly owns the admitted insurer; (3) is a wholly-owned subsidiary of the insurance holding company that owns or controls the admitted insurer; or (4) is a United States manager of the United States branch of an alien admitted insurer.
TPAs previously exempt pursuant to AS 21.27.630(a)(2) or AS 21.27.650(f) may now have to apply for a license using the application procedures set forth in AS 21.27.040, which require full organization documentation, designation of a compliance officer and satisfaction of all required financial and experience qualifications under AS 21.27.640. However, the Bulletin does not provide specific guidance about the process, and the Division has not yet posted any additional guidance about the process or updated the application forms on its website to reflect the changes under Senate Bill 132.  
Moving forward, TPAs that are exempt from licensure will be required to annually certify their exempt status with the Division by submitting the Division’s Exempt TPA Annual Certification Form, pursuant to AS 21.27.630(l). Licensed TPAs will continue to have quarterly reporting requirements under the new law. Additionally, TPAs may now be examined under the same authority as an insurer operating in Alaska pursuant to AS 21.06.120(a), and TPAs are financially responsible for paying the cost of an examination.

Chuck Bassett Appointed to Lead Arizona Department of Insurance and Financial Institutions
Arizona Governor Katie Hobbs has appointed Chuck Bassett as Director of the Arizona Department of Insurance and Financial Institutions, effective Monday, January 12. Mr. Bassett was previously Vice President of Government Relations and Public Policy at Blue Cross Blue Shield of Arizona (BCBSAZ), a role he held since 2004.  Prior to his tenure at BCBSAZ, Mr. Bassett also worked in private practice in insurance regulatory law and served as the Rules Attorney and Counsel to the Rules and Ethics Committees at the Arizona House of Representatives. Mr. Bassett’s confirmation hearing is expected to be held sometime this spring. The Arizona Department of Insurance and Financial Institutions Issues Notice of Opportunity to Comment on Draft Regulatory Bulletin
The Arizona Department of Insurance and Financial Institutions has issued a Notice of the Opportunity to Comment on a proposed draft Regulatory Bulletin that rescinds previously issued Bulletin 2025-03, which addressed the inclusion of ancillary coverages in personal auto and homeowners’ policies that can be obtained through a service contract. The new draft bulletin addresses what the Department considers best practices for insurers to educate consumers about these ancillary coverages, either by identifying the coverages and related premiums on policy declaration pages or through endorsements, and to educate consumers about how filing claims for coverage under these ancillary coverages may impact underwriting and renewal. The Department has asked for comments no later than February 4, 2026. Artificial Intelligence Bill of Rights Emerges in Florida Senate
In a priority of Gov. Ron DeSantis, a Senate Republican filed a proposal dubbed the Artificial Intelligence Bill of Rights. The proposal (SB 482), filed by Sen. Tom Leek, R-Ormond Beach, includes such things as steps to keep “harmful” content from minors. It comes after DeSantis called for an AI bill of rights — and after President Donald Trump issued an executive order seeking to limit state-by-state regulation of the fast-growing technology. Citizens Property Insurance Corp. Drops Below 400,000 Policies
Citizens Property Insurance Corp. has reduced its policy count to 396,387, the lowest level since at least 2012, as Florida continues efforts to shift customers back to the private market. The insurer, once the state’s largest with 1.4 million policies in 2023, has seen steady declines due to a depopulation program and legislative reforms aimed at reducing litigation costs. Officials hope to shrink Citizens further to mitigate financial risks from major hurricanes. Citizens Proposes Rate Reductions for Many Policyholders
Citizens Property Insurance Corporation, Florida’s state-backed insurer created to provide coverage when private options are unavailable, announced on December 10 that its Board of Governors has approved proposed 2026 rates that would lower average premiums for personal lines customers for the first time since 2015, reflecting how recent legislative changes have strengthened the state’s property insurance landscape. Commissioner Mike Yaworsky Approves 6.9% Rate Decrease for Florida Workers’ Compensation Policies, Marking 9th Consecutive Year of Decreases
Florida Insurance Commissioner Mike Yaworsky issued a Final Order approving a statewide overall rate decrease of 6.9% for workers' compensation policies. The reduction proposed by the National Council on Compensation Insurance (NCCI), applies to both new and renewal policies effective in Florida starting Jan. 1, 2026. FEMA Recovery Support in Florida Tops $11 Billion as State Advances Helene and Milton Rebuilding Efforts
According to FEMA, more than $11 billion in grants, community reimbursements, and flood-insurance payments have now been provided to support Florida’s recovery. This includes over $1.8 billion obligated to the state to reimburse local communities for debris removal, emergency protective measures, and repairs to critical infrastructure. Florida Pays a Tort Reform Dividend
Florida Gov. Ron DeSantis’s litigation reforms are starting to pay off for the state’s citizens in a big way. Auto and home insurers are announcing rate cuts—and get this—even issuing rebates. State Farm said recently it will reduce auto rates in the Sunshine State by 10%. Combined with last year’s premium cut, its policyholders will save $400 a year on average. Florida’s Insurance Reforms Are Paying Off
Prior to the 2023 reforms, Florida accounted for only 8% of all U.S. homeowners’ insurance claims but 76% of lawsuits against homeowners’ insurance companies. Heritage Insurance Provides Honors to First Responders in Hillsborough County
