Incumbent Democrat Trinidad Navarro was challenged by Republican Ralph Taylor who previously served as a Dover city councilman. Commissioner Navarro defended his seat with 58% of the vote. CFO Jimmy Patronis Deploys Three Anti-Fraud Strike Teams Following Hurricane Milton

Chief Financial Officer (CFO) & State Fire Marshal Jimmy Patronis has activated his Disaster Fraud Action Strike Teams (DFAST) to protect Floridians from storm-related fraud. This deployment will consist of three teams with 18 sworn law enforcement officers who are working to educate and inform the public on signs of post-storm fraud and ensure contractors are following state workers’ compensation law. Citizens Property Insurance Corporation

Florida’s Citizens Property Insurance Corporation has been steadily decreasing its policy count due to the success of its Depopulation Program, which allows private insurers to assume policies rom Citizens with approval from the Florida Office of Insurance Regulation. As of October 24, 2024, Citizens had 1,035,534 policies. In 2024 alone, over 1.3 million policies were approved to shift from Citizens to private insurers. Click here  to read more.

Federal Emergency Management Agency Extends Renewal Period for Flood Insurance Policyholders in Florida Affected by Hurricane Milton

The National Flood Insurance Program has extended the proof of loss requirement for policyholders from Hurricane Milton from the standard 60 days to 120 days from the date of loss. The NFIP has also permitted its Write Your Own insurance company partners and the NFIP Direct to pay claims based on the adjuster’s report without requiring policyholders to sign a proof of loss. FLOIR Amends Hurricane Helene Emergency Order

On September 30, 2024, the Florida Office of Insurance Regulation issued Emergency Order 400385-24 to assist Florida policyholders in the wake of Hurricane Helene.  Among other things, the Emergency Order implemented grace periods for insured’s to make premium payments and comply with other policy provisions and also a moratorium which restricted an insurer’s ability to non-renew or cancel policies until November 26, 2024.  The Emergency Order was subsequently amended on October 16, 2024, in pertinent part to extend the grace period/moratorium until December 10, 2024.  The Emergency Order was issued after Governor Ron DeSantis issued Executive Order 24-20, which, in pertinent part, declared a state of emergency in several counties throughout the state and activated certain provisions of the Florida Insurance Code which authorize the Insurance Commissioner to implement certain emergency policyholder protections. Florida State Board of Administration Approves the Updated Florida Hurricane Catastrophe Fund Reimbursement Contract

The updates reflect the 2025-2026 contract year. The proposed rule makes the following substantive changes to the Reimbursement Contract for Article V. Subsection (7), pertaining to the definition of “Borrowing Capacity” to determine what funds make up the FHCF Borrowing Capacity. Furthermore, Article X. Subsection (3)(d) was updated to provide language that establishes how the FHCF calculates reserves for all Contract Years and not just previous Contract Years. Click here  to read more.

Florida’s Insurance Commissioner Provides Updates on Continued Property Insurance Market Stabilization

Insurance Commissioner Michael Yaworsky announced additional reassuring expansions related to the state’s strengthening property insurance market. As of October 9, 2024, 15 companies have made a total of 22 filings for a rate decrease reaching 1.5 million residential policies to take effect in 2024 and 29 companies have made 42 filings for a zero percent increase reaching 1.9 million residential policies. Governor Ron DeSantis Issues Executive Orders Regarding Hurricane Helene and Hurricane Milton

Governor DeSantis issued Executive Order 24-212, Executive Order 24-213, and Executive Order 24-234. Executive Order 24-212 relates to actions to ensure election activities are not disrupted by Hurricane Helene. Order 24-213 issues directives to the Florida National Guard, Florida State Guard, Department of Transportation, and the Florida Department of Highway Safety and Motor Vehicles to take certain actions to mitigate potential disruptions caused by the ongoing port strikes and those recovering from Hurricane Helene. Governor Ron DeSantis Provides Updates on State Response and Recovery Efforts for Hurricane Milton

Governor DeSantis announced the award of $9.5 million to SeaPort Manatee towards recovery and infrastructure repair following the damage caused by Hurricane Milton. Additionally, $500,000 through the Florida Disaster Fund will be funded to non-profit organizations in the state that provide free muck-and-gut services, debris removal, tarping, temporary home fixes, and other volunteer services to homes that have been damaged or destroyed by a Hurricane. New Florida Law Will Require Real Estate Sellers To Disclose a Property’s Flood Risk

A new law passed by the Florida Legislature on May 21, 2024 imposes new disclosure requirements on sellers in connection with the sale of real state in Florida.  CS/CS/HB 1049 requires that sellers must disclose flood risks to prospective purchasers of residential real estate.  Specifically, a seller must provide a flood disclosure to a purchaser of residential real property at or before the time the sales contract is executed. The flood disclosure must include key information regarding the property’s flood risk, including whether the property has been the subject of any insurance claims stemming from flood damage, and whether federal assistance was provided due to flooding. New Portal Established for Catastrophe Reporting Resources and is Currently Available

In the event of a hurricane or other natural disaster causing catastrophic damage in the State of Florida, it will likely become necessary for the Florida Office of Insurance Regulation (Office) to institute a data call for the purposes of collecting claims and other relevant information from insurance companies. This authority is mandated pursuant to Section 624.307, Florida Statutes.
Insurance companies will be notified when to begin reporting county and statewide information related to the event and how to submit it using the current year's Catastrophe Reporting Form. General company, contact and statewide modeling information along with claims data addressing the following lines of business will be collected: homeowners, dwelling, mobile homeowners, commercial residential, commercial, private flood, business interruption, and other. Companies upload the requested information via the Insurance Regulation Filing System  (IRFS) at specified time intervals as determined by OIR.
OIR may use the aggregated data in summary reports and other materials in order to provide the general public with information concerning the impact of a catastrophic event on Florida’s insurance industry. Click here  to learn more.

NOTICE TO INDUSTRY: Florida Law Reminder for Early Prescription Refills 10/6/2024 Published: Oct 6, 2024

This notice is a reminder that all health insurers, managed care organizations, pharmacy benefit managers and other health entities must comply with provisions of section 252.358, Florida Statutes, which allows for early prescription refills in the event the Governor issues an Executive Order declaring a State of Emergency. This mandate remains in effect until the Governor’s Executive Order is rescinded or expires.

DIRECTIVE 24-EX-9: Insurance Companies Across All Lines of Coverage – No Cancellations for Failure to Pay in Hurricane Helene Affected Areas

On October 24, 2024, Commissioner John F. King issued Directive 24-EX-9 as a follow-up to Directive 24-EX-6, which prevented insurance companies from canceling policies in certain counties affected by Hurricane Helene.
As a result of recovery efforts, the restrictions on cancelling policies which were imposed by Directive 24-EX-6 were lifted effective as of October 31, 2024.

Georgia Access to Launch a State-based Exchange in November to Replace Healthcare.gov

Georgia Access, a State-based Exchange, went live as the official health insurance marketplace in the state on November 1, 2024, as Open Enrollment 2025 commences. It provides eligible Georgians with multiple options to enroll in affordable healthcare insurance coverage through web brokers, agents and directly with Georgia- licensed health insurers.
Consumers may begin shopping for health coverage on November 1, but coverage will begin on January 1, 2025, for consumers who select a plan by December 16, 2024.

Georgia Appeals Court Reverses Trial Court Allowing Direct Action Against Liability Insurer of a Ride-Share Company

In an August 26, 2024, opinion of the Georgia Court of Appeals, Barnes v. State Farm Fire & Cas. Co.  (Ga. Ct. of App. Case No. A24A952), the court held that a third party driver involved in a collision with a Lyft driver could sue State Farm Fire and Casualty Company, the liability insurer of Lyft, directly under Georgia’s direct action statute, O.C.G.A. § 40-1-112(c),  and that a ride-share company is a “motor carrier” for purposes of that statute.

Georgia Supreme Court Holds Non-Solicitation Agreements Do Not Require Express Geographic Territorial Limitation

In a September 4, 2024, opinion of the Georgia Supreme Court, North American Senior Benefits v. Wimmer (Ga. Sup. Ct. Case No. S23G1146),  the court held that a non-recruitment of employees agreement does not have to specify an express geographical territorial limitation to be enforceable. North American Senior Benefits, an insurance marketing organization, and husband and wife Ryan Wimmer and Alisha Wimmer, who were insurance agent employees of North America, had entered into employment agreements prohibiting the Wimmers from recruiting North America’s employees during the two-year period following termination of the Wimmers’ employment agreements. The Wimmers established a competing business after termination of their employment agreements and allegedly violated the non-recruitment covenants, which did not contain an express territorial limitation. Both the trial court and Georgia Court of Appeals held that these non-recruitment covenants were unenforceable for lack of an express geographic term under the Georgia Restrictive Covenants Act, specifically, O.G.G.A. § 13-8-53(a),  which requires a reasonable geographic area. The Georgia Supreme Court reversed the lower courts, finding that an implied (and reasonable) geographic area could exist by reference to North American and its other employees regardless of the other employees’ locations of work, and remanded the case for determination of whether the requisite reasonableness exists in this case.

The Indiana DOI Announces All Payer Claims Database Website

The Indiana Department of Insurance (IDOI) announced on August 5, 2024, the launch of the Indiana All Payer Claims Database (APCD) website. The Indiana APCD is a statewide database that collects healthcare claims information from various sources, such as health insurers, and provides valuable healthcare insights for all Hoosiers.
This interactive tool allows consumers to shop for health care services by comparing price and quality of care across the state. According to IDOI Commissioner Amy L. Beard, this valuable tool allows consumers to make data-driven decisions and ultimately enhance the well-being of all Indiana residents. Visit the Indiana APCD website here.
